3. General Principles and Applicable Scope of Intellectual Property Protection
3.1 General Protection Principles
In compliance with general global cross-border e-commerce intellectual property protection norms and international compliance standards, the Platform adheres to the principles of compliance priority, proactive prevention and control, rapid disposal, long-term governance and global adaptation, and builds a full-process, intelligent and international intellectual property protection system. It strictly implements full-chain management including pre-access review, in-process dynamic monitoring and post-event disposal and rights protection, takes into account differences in intellectual property laws and regulations of different countries and regions worldwide, equally protects the legitimate rights and interests of domestic and foreign right holders, and strives to maintain a compliant cross-border trade ecosystem on the Platform.
3.2 Protection Scope
The types of intellectual property rights protected by this Plan cover core rights and interests of all categories in international trade, specifically including:
• Copyright: Original works such as product real photos, design drawings, promotional videos, copywriting contents, software programs, page designs and artistic works;
• Trademark Right: Domestic and foreign registered trademarks, brand logos, identifiers, trade names, package designs, brand slogans and other related rights;
• Patent Right: Legally authorized global patents including product invention patents, utility model patents and design patents;
• Other Intellectual Property Rights: Legitimate rights and interests such as trade secrets, exclusive design schemes, customized supply chain technologies and brand licensing operation rights.
4. Platform Intellectual Property Compliance Control System
4.1 Pre-access Review Mechanism for Settlement
The Platform establishes a strict pre-access review mechanism for merchant settlement and product listing to eliminate infringement risks from the source, in line with international cross-border platform compliance standards, and implements dual verification of merchant qualifications and intellectual property rights.
First, during merchant settlement, the Platform compulsorily verifies enterprise business licenses, brand licensing certificates, trademark registration certificates, patent certificates and other qualification documents. Merchants without legitimate intellectual property ownership or authorization qualifications are prohibited from settling in and opening stores.
Second, during new product listing, the system automatically verifies product images, copywriting, styles and brand information, with manual recheck for high-risk categories to intercept the listing of infringing products involving image theft, brand counterfeiting, plagiarism and piracy.
Third, a special pre-review system is implemented for cross-border hot-selling and high-risk infringing categories to comprehensively reduce the incidence of intellectual property infringement disputes on the Platform.
4.2 In-process Dynamic Monitoring and Intelligent Prevention & Control
The Platform builds a 24/7 all-weather intellectual property monitoring system based on intelligent technologies to realize active identification, early warning and timely disposal of infringing acts. Through technical means such as image comparison, text duplicate checking, style recognition and brand keyword screening, the Platform real-timely monitors all products, graphic contents and store information on the site to accurately identify infringements including image theft, copywriting plagiarism, brand counterfeiting and patent counterfeiting.
Meanwhile, the Platform establishes a dynamic ledger of global infringement information, synchronizes and updates new global intellectual property compliance regulations, and dynamically adjusts platform control standards according to legal requirements of different overseas markets to avoid cross-border intellectual property compliance risks. Suspected infringing contents detected by monitoring will automatically trigger early warnings and be temporarily suspended from display, and can be restored only after merchants complete verification and proof submission.
4.3 Post-event Infringement Disposal and Graded Penalty Mechanism
In accordance with international cross-border platform infringement disposal standards, the Platform establishes a classified and graded penalty mechanism to implement differentiated disposal based on the severity of infringement circumstances, ensuring fair and effective management and control.
Minor Infringement: Refers to unintentional first-time infringement without malicious profit-making and adverse impacts. Disposal measures: Immediately remove infringing products and delete infringing contents, issue formal compliance warnings and online compliance education to merchants, and require merchants to rectify within a time limit and submit a compliance commitment letter.
Moderate Infringement: Refers to repeated minor infringements, minor brand counterfeiting and theft of a small number of materials. Disposal measures: Remove all relevant infringing products, block infringing contents, deduct merchant platform credit scores, restrict store authorities including new product listing, traffic exposure and activity registration, and order merchants to complete rectification and review.
Severe Infringement: Refers to malicious brand counterfeiting, mass piracy, patent counterfeiting, repeated violations, and acts causing major brand losses or platform public opinion risks. Disposal measures: Permanently remove infringing products, close violating stores, freeze platform account rights and interests, blacklist the involved merchants with permanent settlement prohibition. The Platform will retain infringement evidence, assist right holders in rights protection, and pursue the civil, administrative and even criminal liabilities of the involved merchants in accordance with the law.
